Modify Child Support in California: Can I Modify Support Without DCSS?

I estimate that my costs were about 25% of what it would have cost if I could have hired an attorney for my case by the hour. BTW to keep costs down, I could have met with the intake worker in sacramento but they had someone that would be near me on a specific date, so i set it up to meet locally near the court as my case is not in this county. If it wasn't for this group I doubt I would have been able to get any help on the case due to my limited financial situation

In many cases, custodial parents assign their cases to the Dept. of Child Support Services who then usually garnish the other parties' wages. However not all parties use DCSS unless they have to do so; or some parties find that DCSS does not give non-custodial parents a fair chance; or some find that they hate DCSS and don't enjoy working with them. DCSS personnel do not represent the parties or party that they garnish funds from, and they do not represent the party that gets the support. DCSS is in an unusual position of handling the task of obtaining the money by using the state funded agency (DCSS) but since they are not paid nor allowed to be paid by clients, they are not considered to be actually "representing" clients as a private attorney would be. There are many different rules regarding how DCSS operates, but the best thing about DCSS is that they are linked to the EDD and can find out whether the non custodial parent is registered as an employee. They can then execute and levy on the wage earner's money. Because many wage earners do not like the DCSS, DCSS workers are used to seeing what is termed "deadbeat" parents, or parents that cannot afford to pay, or parents that simply ignore their payments and quit their jobs. In part, this is the fault of the California legislature that decided how much support should be paid, and it is directly linked to a time formula. This usually means that a mother may get custody and a father would pay for the support. Where parents both share custody often there is no support paid, but in some instances there may be payments. If you believe that you are entitled to support, or entitled to change or modify your support upward or downward, you would not likely know the correct support amount; even if you used the guideline calculator, there are items that may be overlooked or items that are not mentioned that would affect the support. The self employed parent usually ends up paying the least amount of support due to the tax structure for self employment.
