Inquiries found no abuse before little girl's death, CPS says
Two months before 4-year-old Betsabeth Sandoval died after suffering numerous injuries, two bone fractures and malnourishment, Child Protective Services investigated allegations of abuse against the girl but found nothing requiring more scrutiny.
CPS caseworkers reported observing no injuries on Betsabeth on both occasions they visited the child's Houston home in April after receiving reports that she had bruises on her face and swollen eyes, according to the agency's spokeswoman Estella Olguin.
However, an autopsy performed on the girl, who died June 3, revealed she had bruises, fractures and was underweight for her age. The autopsy also found that some of her injuries were healing, indicating she had suffered over a length of time.
On Monday, police charged the child's mother, 27-year-old Maciel Sandoval, and her roommate, Judith Herrera-Garcia, 35, with injury to a child, alleging that both failed to seek timely medical attention for the girl.
Betsabeth's official cause of death is awaiting further review by the Harris County Institute of Forensic Sciences. The completed autopsy findings could potentially change the charges against Sandoval and Herrera-Garcia, said Houston Police Department spokesman Victor Senties.
Claims of abuseClaims of abuse against Betsabeth surfaced March 26, and CPS caseworkers visited the child's residence in the 5800 block of West Sunforest on April 1 and April 29.
During their investigation, Betsabeth's pediatrician, who had examined the girl shortly before receiving inquiries from CPS, told caseworkers he had no concerns about abuse or neglect. He described her appearance as "well nourished" and "well developed," Olguin stated in an email.
Caseworkers also interviewed Herrera-Garcia's 14-year-old son, who denied any abuse or neglect against him or Betsabeth. CPS took emergency custody of the boy Wednesday after his mother was arrested. Olguin said CPS took custody of the boy because he has no other family in Texas that can care for him.
The only wound reported to CPS by the family was an old shoulder injury that Betsabeth received when she fell in a park playground in early March. The child's doctor told caseworkers that he'd examined the girl twice for the injury, and an X-ray showed no fractures to Betsabeth's shoulder, Olguin said. He also stated that the injury was consistent with the family's explanation of how it happened, Olguin said.
